The UnitedHealth Group (UHG) Privacy office is hiring an Associate General Counsel to help support its mission to make the health system work better for everyone. This position focuses heavily on the HIPAA Privacy and Security Rules, state privacy law, state breach notification laws and implementation of new federal and state privacy laws. The position is dedicated to supporting a region of Optum Health's Care Delivery businesses that provide both direct patient treatment and undertake delegation from contracted health plans. The successful candidate should have a health information privacy background and experience working with HIPAA and state privacy laws as part of supporting provider groups and health plan delegation. Experience working with CA state laws with privacy impact is highly preferred. The position will report to the Optum Senior Associate General supporting Optum Health's Care Delivery business and will work closely with the Optum Health Care Delivery Compliance team.

Primary Responsibilities:



  • Provide dedicated, actionable legal guidance and counsel to the Optum Health Care Delivery business, with a primary focus on HIPAA and state privacy law compliance
  • Work closely with other members of the Optum Health Care Delivery Privacy and Compliance teams
  • Provide counsel to regulatory change management and implementation of new privacy laws and regulations
  • Develop, manage and implement HIPAA and state law requirements unique to providers including training and education, communication, policy and procedure advice and Notice of Privacy Practices distribution
  • Provide business associate agreement and contracting support for segment legal counsel and contracting teams
  • Provide counsel to the Optum incident management team and handle regulatory inquiries, including interactions with the Office of Civil Right (OCR) enforcement offices, required reporting to HHS, and state attorneys general
  • Support the HIPAA individual rights function in the Optum Health Care Delivery businesses
  • Delivery privacy reports/updates to business and privacy leadership on a quarterly or other periodic basis
  • Collaborate with internal departments to perform due diligence for potential new acquisitions and integration
  • Respond to request for comments from government agencies regarding proposed regulations
  • Conduct privacy assessments, audits and reviews
  • Stay abreast of developing legal landscape and industry best practices

Required Qualifications:



  • JD Degree
  • Current license to practice law
  • 5+ years of experience practicing law
  • 3+ years of experience in privacy legal environment



Preferred Qualifications:



  • Certified Information Privacy Professional (CIPP) designation or similar
  • Experience with HIPAA and state law requirements unique to providers
  • Experience working with CA state laws with privacy impact
  • Experience working in a large, matrixed environment

The salary range for this role is $124,500 to $239,400 annually based on full-time employment. Pay is based on several factors including but not limited to local labor markets, education, work experience, certifications, etc. UnitedHealth Group complies with al minimum wage laws as applicable.
