The Senior Labor & Employment Counsel provides a variety of legal services to CPCCo management and staff. Such services include performing research, drafting legal opinions, providing legal advice and counsel to management, performing investigations, engaging with opposing counsel and developing the company's legal strategy and representing the company in labor arbitrations with the Bargaining Unit, when needed, directing the activities of outside counsel in litigation and other matters, participating in trial work both individually and as support to outside counsel, and carrying out the legal processes necessary to affect the rights, privileges, and obligations of the company. Additional responsibilities include preparing and reviewing legal and technical documents, and representing the company in negotiations, general company corporate matters, and training management when needed on vulnerabilities the company may face in the labor and employment arenas.

This position is for an attorney with well-developed counseling, investigative, negotiation, and litigation skills who has experience in representing employers or government agencies as employment or labor counsel. The position will provide day-to-day legal support and advice to Human Resources professionals and senior business managers on employment and labor issues in support of CPCCo's management and operations at the Hanford Site.The position will oversee litigation in various forums, sometimes supervising outside counsel and sometimes handling the matter in-house. In addition to managing litigation, the attorney in this position will need to be able to deliver real-time legal advice in the context of the company's strategic mission and business objectives. When responding to specific requests for legal advice, the attorney will also need to be able to evaluate and identify other existing legal vulnerabilities and business impacts beyond the scope of the request.

Essential Functions include but are not limited to:

* Preparing and reviewing Labor & Employment, procurement, and other legal documents in connection with CPCCO's operations, technology, and business.

* Managing all aspects of labor arbitrations, including communicating with opposing counsel, responding to requests for information, preparing for and handling the hearing, and drafting briefs.

* Providing advice and counsel on an ongoing basis to the company's Human Resources and other business organizations. In addition, when necessary, engaging with management in resolving issues, conflicts, and disputes that arise within those organizations.

* Counseling CPCCO management as to legislation, court decisions, industry issues, evolving legal theories, regulations, judicial and quasi-judicial rulings, and corporate policy and procedures.

* Drafting original documents and conducting negotiations involving complex and high value transactions.

* Drafting guidance and conducting training for CPCCo management and staff on workplace laws and best practices such as anti-discrimination, employee discipline, and union rights.

* Interacting and coordinating with attorneys in the U.S. Department of Energy's Office of Chief Counsel for the Hanford Field Office (HFO), as well as HFO management and staff, as needed.

* Analyzing complex legal issues and legal theories as they relate to the company's business.

* Researching legal references and preparing opinions where there may be little applicable statutory, regulatory, or case material.

Coordinating responses to discovery requests and pursuing alternate methods of resolving disputes.

* Drafting correspondences and assuring communication and timely responses to and from outside attorneys, company staff, and insurance carriers.


Basic Qualifications


* Grade 22 - Juris Doctor (JD), plus 8 years of relevant experience.

* Grade 23 - Juris Doctor (JD), plus 10 years of relevant experience.

* Must be admitted to the Washington State Bar or ability to obtain a limited House Counsel license pursuant to Washington Supreme Court Admission Rule 8(f) within one year of start of employment.

The higher posted level has greater scope, complexity, authority, impact. The level offered to the selected candidate will be based on the needs of the company and the candidate's education, training, and/or experience.


Desired Qualifications


* Extensive Experience working with National Labor Relations Act of 1935 (NLRA), and Fair Labor Standards Act (FLSA).

* Extensive Experience with employment law such as FMLA, PFML, ADA, Title VII, PWFA.

* A working knowledge of the Federal Acquisition Regulation (FAR) and Department of Energy Acquisition Regulation (DEAR).

* Experience with DOE complex and contractor compliance.

* Experience including extensive work in governmental contracting.

* Experience in multiple legal disciplines including, though not limited to, corporate governance law, environmental law, contract law, labor law, procurement, and human resources.


Compensation & Benefits


In accordance with the CPCCo salary determination process, CPCCo takes into consideration the level of assigned job duties and responsibilities, and the candidate's education, training, and/or experience relative to internal peers and the external labor market. CPCCo will not solicit salary history for candidates.

Expected annualized pay range based on full time schedule (40 hours per week):

* Grade 22: $159,363 - $209,688.

* Grade 23: $183,300 - $241,300.

* Relocation Eligibility: Must be located greater than 50 miles from Richland, WA 99352. If eligible for relocation, the Not To Exceed (NTE) range offered to the selected candidate will be based on the needs of the company and the candidate's education, training, and/or experience in relation to the position grade level offered. The higher posted level has greater scope, complexity, authority, impact.
